CONCERNING
TRYING OF ELECTRONIC DATA EXCHANGE (PDE) IMPLEMENTATION OF NOTIFICATION OF IMPORTED GOODS TO BE PILED IN BONDED HOARDING PLACE (BC 2.3)

THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE,

Considering:

that in the framework of trying of application program for Electronic Data Exchange (PDE) on the submission documents of Notification of Imported Goods to be piled in Bonded Hoarding Place, it is necessary to issue the Decree of the Director General of Customs and Excise concerning Trying of Electronic Data Exchange (PDE) Implementation of Notification of Imported Goods to be piled in Bonded Hoarding Place (BC 2.3);

In view of:

1. Law Number 10 of 1995 concerning Customs (Statute Book of the Republic of Indonesia Number 75 of 1995, Supplement to Statute Book of the Republic of Indonesia Number 3612); as amended by Law Number 17 of 2006 (Statute Book of the Republic of Indonesia Number 93 of 2006, Supplement to Statute Book of the Republic of Indonesia Number 4661);

2. Law Number 11 of 1995 concerning Excise (Statute Book of the Republic of Indonesia Number 76 of 1995, Supplement to Statute Book of the Republic of Indonesia Number 3613); as amended by Law Number 39 of 2007 (Statute Book of the Republic of Indonesia Number 105 of 2007, Supplement to Statute Book of the Republic of Indonesia Number 4755);

3. Government Regulation Number 32 of 2009 concerning Bonded Hoarding Place (Statute Book of the Republic of Indonesia Number 61 of 2009, Supplement to Statute Book of the Republic of Indonesia Number 4998);

4. Regulation of the Minister of Finance Number 155/PMK.04/2008 concerning Customs Notification;

5. Regulation of the Director General of Customs and Excise Number P-20/BC/2008 concerning Procedure for Releasing Imported Goods from Customs Territory to be Piled in Bonded Hoarding Place;

6. Regulation of the Director General of Customs and Excise Number P-22/BC/2009 concerning of Import Customs Notification;

DECIDES:

To stipulate:

REGULATION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE CONCERNING TRYING OF ELECTRONIC DATA EXCHANGE (PDE) IMPLEMENTATION OF NOTIFICATION OF IMPORTED GOODS TO BE PILED IN BONDED HOARDING PLACE (BC 2.3).

Article 1

In this Regulation the following meanings:

1. Electronic data exchange hereinafter abbreviated as PDE is the submissions of customs documents in the form of integrated electronic data interchange through inter applications and inter organizations communication by using the data communications systems.

2. Bonded Hoarding Place is a building, place, or area that meets certain requirements that is used to pile goods with certain purpose by bet suspension of import duty.

3. Import Customs Notification is statement made by people in the framework to implement the Import Customs Obligations in the form and conditions are determined by Customs Law.

4. Director General is the Director General of Customs and Excise.

5. Customs Offices are offices in the Directorate General of Customs and Excise environment where compliance with customs obligations in accordance with the Customs Law.

Article 2

Trying of PDE of Notification of Imported Goods to be piled in Bonded Hoarding Place (BC 2.3) is implemented in some of the Customs Offices had had Customs PDE network with the schedule as in attachment that is an integral part of this Regulation the Director General.

Article 3

(1) Trying of PDE of Notification of Imported Goods to be piled in Bonded Hoarding Place (BC 2.3) is applied for Bonded Hoarding Place Entrepreneur already fulfill following requirements:

a. Do activities of Bonded Hoarding Place management activities under the control of the Customs Office as intended in Article 2;
b. Has enough preparation of structure and infrastructure for implementation of PDE Service Application System of Notification of Imported Goods to be stored in Bonded Hoarding Place (BC 2.3);
c. Determined by the Director-General as trying participants.

(2) Participants trying of PDE of Notification of Imported Goods to be piled in Bonded Hoarding Place (BC 2.3) as intended in paragraph (1) are determined by Director of Customs Facility on behalf of Director General with Notification Letter.

(3) Determination of participants trying of PDE of Notification of Imported Goods to be piled in Bonded Hoarding Place (BC 2.3) as intended in paragraph (2) performed by take attention to the inputs from the Head of Customs Offices.

Article 4

Participants trying of PDE of Notification of Imported Goods to be piled in Bonded Hoarding Place (BC 2.3) submit Notification of Imported Goods data to be piled in Bonded Hoarding Place by using modules of Bonded Piling Place entrepreneurs in electronically.

Article 5

This Decree of the Director General shall come into force since the date of enactment and ends when the fully application (mandatory) of obligation for submission of Notification of Imported Goods to be piled in Bonded Hoarding Place.
